Caverly Digital Marketplace ("we," "our," or "us") respects the intellectual property rights of others and is committed to complying with the Digital Millennium Copyright Act (DMCA). This DMCA Protection Policy outlines how we handle copyright infringement claims and how users can file a notice or counter-notice in accordance with the DMCA. By using our platform, you agree to abide by this policy.

1. Copyright Infringement Notifications
If you believe that any content or product available on Caverly Digital Marketplace infringes upon your copyright, you may submit a DMCA Takedown Notice to our designated Copyright Agent. Upon receipt of a valid takedown notice, we will promptly investigate the claim and take appropriate action, which may include removing or disabling access to the infringing content.

2. Filing a DMCA Takedown Notice
To file a DMCA Takedown Notice, please provide the following information in writing to our Copyright Agent:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work(s) claimed to be infringed.
  • Identification of the material that is claimed to be infringing and information sufficient to locate the material (such as a URL or product page link).
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information provided in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Please note that if you knowingly misrepresent that material on Caverly Digital Marketplace is infringing, you may be held liable for damages (including costs and attorneys' fees).

3. Response to DMCA Takedown Notices
Once we receive a valid DMCA Takedown Notice, we will take the following steps:

  • Remove or disable access to the allegedly infringing material.
  • Notify the user who uploaded the material that it has been removed or disabled.
  • If the user believes the material was wrongly removed, they have the right to submit a counter-notice (as described below).

4. Filing a DMCA Counter-Notice
If you believe your material was removed in error or that you have the right to use the material, you may file a DMCA Counter-Notice. To file a counter-notice, please provide the following information in writing to our Copyright Agent:

  • A physical or electronic signature of the user submitting the counter-notice.
  • Identification of the material that has been removed or disabled and the location where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, phone number, and email address.
  • A statement that you consent to the jurisdiction of the federal court in your district (or in the jurisdiction where your address is located) and that you will accept service of process from the person who filed the DMCA Takedown Notice or their agent.

Once we receive a valid DMCA Counter-Notice, we will:

  • Forward the counter-notice to the person who filed the original takedown notice.
  • Restore the removed material if the original complainant does not file a lawsuit within 10-14 business days.

5. Repeat Infringer Policy
Caverly Digital Marketplace takes copyright infringement seriously. In accordance with the DMCA, we maintain a repeat infringer policy. Users who are found to repeatedly infringe on copyright will have their accounts suspended or terminated. We reserve the right to terminate accounts or disable access to users who we determine to be repeat offenders.

6. Misrepresentation of Claims
The DMCA provides for penalties for false claims of copyright infringement. If you file a DMCA takedown notice or counter-notice with false or misleading information, you may be liable for damages, including costs and attorneys' fees.

7. Changes to This Policy
We reserve the right to update or modify this DMCA Protection Policy at any time. Any changes will be posted on this page, and continued use of our platform following any updates constitutes your acceptance of the revised policy.
